Three Times in Court; Defence for Cherenfant asks for Dismissal

#TurksandCaicos, August 18, 2023 – DELIVERANCE CHERENFANT, busted and charged with allegedly harbouring three illegal Haitians in a locked closet in her apartment is seeking to have her case thrown out through her attorney Chal Missick.

The matter was called once again on August 14th, 2023 for mention but the office of the Director of Public Prosecution (ODPP) still had not disclosed to the defense attorney, Chal Misick the relevant material to commence a trial.

Counsel for the accused told the Chief Magistrate Mr. Jolyon Hatmin, that this is the third time they were to provide us with disclosure in this case and failed to do so, we’re making an application for the matter to be dismissed.

The learned Chief Magistrate told Mr. Misick he accepts the DPP was to disclose and he noted his objections and application to dismiss the case, the application is refused.

Tamika Grant of the Office of the DPP, who accepted that they’ve failed to disclose on three occasions had an apology. She promised the Court to under undertake providing the defense with disclosure and this she begun doing immediately whilst in Court.

The case was adjourned to October 5, 2023 for commencement of a trial.

The accused bail was extended to that date.
