Haitian man seeks overturned conviction, say TCI law enforcers not telling the truth

#TurksandCaicos, November 24, 2017 – Providenciales – The Haitian man who during his own arrest and who managed to take a gun off of a Police officer to hold up that officer and an Immigration officer will hear what the Appeals court has to say about his request to have his conviction overturned.  The police report in the trial was that the two officers managed to talk the man into returning to them, the gun.

The man, Gennesonne Presendues in 2015, committed the crime and has been convicted and sentenced to five years for it.   Presendues claims though that he did not strip the gun off the officer, that the officer dropped the gun and he picked it up and passed it back to them.   His attorney Tim Prudhoe has appealed and a decision on the matter is due today.

Another decision from the appellate court is expected today for Carl Gardiner.  Gardiner, was found guilty and sentenced to six years for faking a robbery and stealing a large deposit – $130,000 – from Butterfield Gold.  Carl Gardiner has been free for about four years now, out of prison on an Appeals court bail since 2013 and the Court has given him until today as a deadline to have an attorney to represent his case.
